Rule of Law
World is changing and so is the Pakistan. The difference is that world is changing rapidly and Pakistan is just hobbling ahead. But the good sign is that like all nights, this long night of dictatorship, status quo, poverty, and lotas is coming to an end. Though this process is very slow, but the dream beats can be heard from far away horizon and you can feel it in the air.
Pakistan of 2008 and beyond is unlikely to accept unilateralism and sheer high-handedness of those in power and they are fed up of lotas of PML-Quisling, and they are really after some change and they want to sink this status quo in Arabian Sea. They are very angry over the suicide attacks and they hate their perpetrators. They are glad that Army is now making some serious progress in curbing people like Fazlulah of Swat, but they want more. They want Army to do what it does best; saving country from the enemies.
Not even a single Pakistani (except Benazir Bhutto, Fazlur Rehman, and Lotas of PML-Q) can deny the sacrifices of the Non-PCO judges. They have become the heroes of Pakistan. They, like Dr. Qadeer, live in the hearts of Pakistanis. Proud Lawyers of Pakistan are toeing the line of Non-PCO judges, and now they have started a movement for the public interest and for supremacy of the judiciary.
It is for the nation to decide as to who showed character in this hour of trail and who lost face. Who has show obedience to the Constitution and who has violated it; who has sacrificed the prestigious and elevated post and who has grabbed a post in violation of law and the Constitution? The judges who have refused to take oath under PCO have certainly upheld the Constitution because at the time of their oath-taking as judge under article 194 of the Constitution they had publicly said that they would preserve, protect and defend the country’s Constitution. Having thus taken oath, it would not be permissible to take a fresh oath under an order which violates the rule of law.
That is why nation loves these judges and all how stand for them. This is the awareness among the masses which is heralding a new dawn.
