Islamic Justice

A complaint was heard against Hazrat Umro-bin-Alas (ra), who was conqueror and Governer of Egypt, at the occasion of Hajj, and at that occasion it was decided that 100 lashed would be applied to him. Hazrat Umro-bin-Alas (ra) said that this would end their hold and the morale would dip down. Hazrat Omar (ra), replied that Allah has created humans liberated, not for his slavery. He also added that there is only one for Hazrat Umro-bin-Alas (ra) to escape the punishment and that is to make complainant satisfied. Then Hazrat Umro-bin-Alas (ra) managed to pay 2 ashrafis for one lash, and escaped the punishment. This was the state of affairs in the ideal Islamic society.

Islam makes no distinction between small and big, rich and poor, and neither Islam approves of any judicial hearing in closed rooms and without the involvement of populace. Islamic history is full with such examples, where justice was done without any discrimination. In the era of every Khalifa-e-Rashid, the justice was free, ubiquitous, agile and transparent.

Even after the first four, Khulfa-e-Rashideen, there are myriad number of examples of good governance and justice. For example, once Sultan Murad Sani, cut a hand of a mason, because he didn’t like a mosque built by mason. Mason complaint to the Qazi. Qazi after hearing the case, order that the hand of Sultan should also be cut, and in front of order of Qazi, Sultan just bowed his head. The mason was so thoroughly impressed, he decided to take ‘Dyat’ instead of ‘Qasaas’.

For a social and progressive society, where justice prevails everywhere, we need to go back to Islamic code of life.
